LE DEPARTMENT Consignment Terms

By submitting an item to LE DEPARTMENT for consignment, the consignor (“you” or “Consignor”) confirms that they have read, understood, and agreed to the following terms.

1. Item Acceptance

All items are subject to inspection and approval by LE DEPARTMENT. We reserve the right to accept or decline any item at our discretion based on its brand, style, condition, authenticity, seasonality, expected resale value, or suitability for our customers.

Acceptance of an item does not guarantee that it will be listed or sold.

2. Ownership and Authenticity

By submitting an item, you confirm that:

  • You are the lawful owner of the item and have the right to consign it.
  • The item is authentic and is not counterfeit, stolen, or subject to any third-party claim.
  • All information you provide about the item is complete and accurate.
  • You have disclosed any damage, alterations, repairs, defects, or missing components.

LE DEPARTMENT may request proof of purchase or additional authenticity information. We reserve the right to refuse or return any item that cannot be authenticated.

If an item is later determined or reasonably suspected to be counterfeit, stolen, or materially misrepresented, LE DEPARTMENT may remove it from sale, cancel the consignment, withhold payment, and return or surrender the item as required by law. The Consignor is responsible for losses, refunds, chargebacks, claims, or reasonable costs resulting from inaccurate information or a breach of these warranties.

3. Pricing and Price Adjustments

LE DEPARTMENT will determine the initial listing price based on the item’s condition, brand, market demand, and comparable resale prices.

We may contact you to recommend lowering an item’s price. Material price reductions will require your approval unless a separate markdown policy has been disclosed and accepted by you.

LE DEPARTMENT does not guarantee that an item will sell or that it will sell at its original or estimated resale value.

4. Consignment Split

When an item sells and the transaction is considered complete:

  • The Consignor receives 55% of the net selling price.
  • LE DEPARTMENT retains 45% of the net selling price as its commission.

For these terms, “net selling price” means the amount paid for the item after discounts, refunds, and chargebacks, excluding sales taxes and shipping charges.

5. Payouts

Consignor payouts are issued by Interac e-Transfer only. Cash payouts are not available.

You are responsible for providing a correct legal name, email address, and any information required to receive the e-Transfer. LE DEPARTMENT is not responsible for delays caused by inaccurate information, email filtering, banking restrictions, an expired transfer, or the Consignor’s failure to accept the payment.

A payout becomes eligible only after the customer’s payment has cleared and any applicable return, cancellation, dispute, or chargeback period has ended. If a completed sale is later refunded or reversed, the related payout may be cancelled or deducted from amounts otherwise payable to the Consignor.

6. No Fixed Consignment Period

There is no fixed consignment period unless LE DEPARTMENT and the Consignor agree otherwise in writing.

It is the Consignor’s responsibility to check on the status of their items. LE DEPARTMENT does not provide routine status updates. We will generally contact you when:

  • An item sells;
  • We recommend a price reduction;
  • We require additional information; or
  • We request that an item be collected or returned.

You are responsible for keeping your email address, telephone number, and other contact information current.

7. Return or Withdrawal of Items

LE DEPARTMENT may end the consignment and request that an item be collected or returned at any time.

If you wish to withdraw an item, you must contact us first and receive confirmation before attempting to collect it. Items may not be immediately available because they could be stored, photographed, displayed, reserved, or involved in a pending transaction.

An item cannot be withdrawn after it has sold or while it is subject to a confirmed order, pending payment, return, dispute, or chargeback.

Any shipping, delivery, or collection costs associated with returning an item are the Consignor’s responsibility unless otherwise agreed in writing.

8. Unclaimed Items

When LE DEPARTMENT requests that an item be collected or returned, you are responsible for responding and making suitable arrangements within the timeframe stated in our notice.

If you fail to respond or collect the item, LE DEPARTMENT may send a final notice using the most recent contact information you provided. Subject to applicable law, items that remain unclaimed after the deadline in that notice may be considered abandoned and may be donated, recycled, returned at your expense, or otherwise disposed of.

9. Loss, Theft, or Damage

Items are left with LE DEPARTMENT at the Consignor’s risk. To the fullest extent permitted by applicable law, LE DEPARTMENT is not responsible for loss, theft, disappearance, accidental damage, fire, water damage, deterioration, or damage caused by handling, display, storage, customers, shipping providers, or other circumstances beyond our reasonable control.

Nothing in these terms excludes responsibility that cannot legally be excluded. The Consignor is encouraged to maintain their own insurance for high-value items.

10. Photography and Promotion

You authorize LE DEPARTMENT to photograph, describe, advertise, display, and promote accepted items through our website, store, social media, email marketing, third-party sales channels, and other promotional materials.

All photographs and promotional content created by LE DEPARTMENT remain the property of LE DEPARTMENT and may continue to appear in archived or previously published materials after the consignment ends.

11. Customer Returns and Disputes

Sales remain subject to LE DEPARTMENT’s customer return and refund policies, as well as applicable laws and payment-provider rules.

If an item is returned, refunded, cancelled, disputed, or charged back, no payout will be due for that transaction. If a payout has already been issued, the amount may be deducted from future payouts or must be repaid to LE DEPARTMENT.

12. Communication

You authorize LE DEPARTMENT to contact you about your consigned items, pricing, returns, payouts, and other matters related to the consignment.

You are responsible for checking communications sent to the contact information you provide. LE DEPARTMENT is not responsible for consequences arising from outdated or incorrect contact details or unanswered messages.

13. Limitation of Liability

To the fullest extent permitted by applicable law, LE DEPARTMENT’s total liability relating to a consigned item will not exceed the amount the Consignor would have received under the agreed consignment split if the item had sold at its active listed price immediately before the event giving rise to the claim.

LE DEPARTMENT is not responsible for indirect, incidental, special, or consequential losses, including sentimental value, anticipated profit, or loss of opportunity.

14. Changes to These Terms

The terms accepted when an item is submitted will apply to that consignment unless both parties agree to a change in writing. LE DEPARTMENT may update these terms for future submissions.

15. Governing Law

These terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any dispute will be handled by the courts located in Quebec, unless applicable law requires otherwise.

16. Agreement

By checking the required agreement box and submitting the consignment form, you confirm that:

  • You have read and understood these Consignment Terms.
  • You agree to be legally bound by them.
  • The information you submitted is complete and accurate.
  • You understand that submission does not guarantee acceptance or sale.
